The Luxury Cot Company Ltd Terms and Conditions
These are the terms and conditions on which we supply product(s) and/or services to you.
Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide product(s) and/or services to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you think that there is a mistake in these terms or require any changes, please contact us to discuss.

We are The Luxury Cot Company Ltd, a company registered in England and Wales, Company Number 16032948. Our Registered address is 70 South Street, Lancing, West Sussex, BN15 8AJ.

If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
When we use the words “writing” or “written” in these terms, this includes emails.
Our contract with you
Our acceptance of your order will take place when we confirm that we are able to provide you with the product(s) and/or services, or upon receipt of payment for the product(s) and/or services, whichever occurs first. At this point, a contract will come into existence between you and us, subject to these Terms and Conditions.
By placing an order and making payment for the product(s) and/or services, you are deemed to have accepted these Terms and Conditions. Payment for the product(s) or services will be deemed as conclusive evidence of your acceptance of these Terms and Conditions.
If we are unable to accept your order, we will inform you of this and will not charge you for the product(s) and/or services. This might be because the product(s) is out of stock, because we have identified an error in the price or description of the product(s) and/or services, because we are unable to meet a delivery deadline you have specified, or because of unexpected limits on our resources which we could not reasonably plan for.
We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
Delivery
Delivery cost is not included. If you have not received a delivery or postage price you must send us a message with your address to receive an accurate price for orders.
Furniture will be quoted once made. We will contact you to arrange a suitable delivery date once we have received your order. Delivery dates are at the discretion of The Luxury Cot Company and when our delivery team is available.
Bedding items and soft furnishings are posted with the courier service Parcel Force:
Bedding Postage UK - £15.
Bedding Postage Ireland - £30.
Soft furnishings is dependent on items & location.
Overseas shipping is priced with comparison online company to obtain the most competitive rate. All shipping fees, taxes, customs and duty is to be paid by the buyer.
The Luxury Cot Company Ltd takes no responsibility for returns if the buyer purchases from outside the UK.
Please be advised The Luxury Cot Company Ltd does not directly deliver goods for overseas shipments. As a result, we hold no liability for any damages that may occur during transit. While we strive to ensure the safe transportation of our products, any issues or damages that may arise during shipping are the responsibility of the shipping provider and the customer.
If you have agreed to transport the goods with a third party shipping company, we want to emphasise that once the goods leave our premises and are in transit, we have no liability for any damages that may occur during handling, exportation, or return.
While we take great care in packaging and preparing your furniture for transportation, we would like to emphasize that once the goods leave our premises and are in transit, we cannot accept liability for any damages that may occur during handling and exportation. All items are carefully checked and photographed to ensure our high quality standards before being shipped to your home.
Our products
The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours or the printed pictures in our brochure accurately reflects the colour of the products. Your products may vary slightly from those images.
If we are making the products to measurements you have supplied us, you are responsible for ensuring that these measurements are correct.
Your rights to make changes
If you wish to make a change to the product(s) and/or services you have ordered, please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the product(s) and/or services, the timing for delivery, or anything else that would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
Our rights to make changes
We may change the product(s) and/or services to reflect changes in relevant laws and regulatory requirements and to implement minor technical adjustments and improvements. These changes will not affect your use of the product(s) and/or services.
In addition, we may make changes to these terms or the product(s) and/or services, but if we do so we will notify you and you may then contact us to end the contract and receive a full refund before the changes take effect. This does not apply to custom made or bespoke items, which are non-refundable under any circumstances.
Providing the product(s)
The costs of delivery will be provided to you during the order process.
During the order process, we will let you know when we will provide the product(s) to you.
If the product(s) is a one-off purchase, we will deliver it to you as soon as possible. We will contact you with an estimated delivery.
We will deliver the product(s) to you within the specified time on the product page from the day you placed your order.
We are not responsible for delays outside our control. If our delivery of the product(s) is delayed by an event outside our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay.
If you have asked to collect the product(s) from our premises, you can collect the product(s) from us during our working hours of 10am to 6pm on Monday-Saturday.
If no one is available at your address to take delivery and the product(s) cannot be posted through your letterbox, we will leave you a note informing you of how to re-arrange delivery.
If you do not collect the product(s) from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot, we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, we may end the contract.
If you have asked us to install the product(s) for you and you do not allow us access to your property as arranged we may charge you additional costs incurred by us as a result. If, despite our reasonable efforts, we are unable to contact you or re-arrange access to your property we may end the contract.
The product(s) will be your responsibility from the time we deliver the product(s) to the address you gave us or you collect it from us.
You own the product(s) outright upon receipt of full payment, except for bespoke, made-to-order, and custom items, for which ownership transfers to you upon completion.
We may need certain information from you so that we can supply the product(s) to you and install them for you. If so, this will have been stated in the description of the product(s) in our brochure or on our website. We will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we will either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying or installing the product(s) late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
We may have to suspend the supply of a product(s) to:

Deal with technical problems or make minor technical changes;

Update the product(s) to reflect changes in relevant laws and regulatory requirements;

Make changes to the product(s) as requested by you or notified by us to you.
Refund Policy for Custom Made and Bespoke Items: We do not offer refunds on bespoke, or custom-made items under any circumstances.
Our rights to end the contract
We may end the contract for a product(s) at any time by writing to you if:

We are unable to collect payment from you when it is due and you still do not make payment within 5 days of us reminding you that payment is due;

You do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the product(s) and/or services; or
-
You do not, within a reasonable time, allow us to deliver the product(s) or collect them from us and/or give us access to your property to provide the services to you.
If we end the contract in the situations set out above, we will charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
We may write to you to let you know that we are going to stop providing the product(s) and/or services. We will let you know at least 5 days in advance of our stopping the supply of the product(s) and/or services.
If there is a problem with the product(s) and/or services
If you have any questions or complaints about the product(s) and/or services, please contact us. You can telephone or Whatsapp our customer service team on +447599 002978 or write to us at info@luxurycotcompany.co.uk. Alternatively, you can speak to one of our staff in-store.
If you wish to exercise your legal rights to reject product(s), you must either return them in person to where you bought them, post them back to us, or (if they are not suitable for posting) allow us to collect them from you. You will pay the costs of postage or collection. This only applies to products that are not custom-made, bespoke, personalised, or made-to-order.
Repairs

All products/services are bespoke and made to order. Due to the personalised nature of our service, we do not offer refunds or cancellations once an order is placed and confirmed.

By placing an order with us, you acknowledge and agree that all sales are final, and we do not accept returns or provide refunds under any circumstance.

Please note, sizes supplied by you the customer can change the overall look of a product. We measure all sizes in centimetres (CM). You must submit your measurements in CM. All measurements are final once your order is placed and The Luxury Cot Company Ltd cannot be held responsible for measurement mistakes. You must check access doors/ stairs, furniture placement measurements as we cannot be held liable for items that do not fit after you have placed your order.

In the event that you receive a faulty item or an item that does not meet the agreed-upon specifications, please notify us within 24 hours of receiving the item. We will investigate the issue and, if verified, we will undertake the necessary repairs to rectify the fault or non-compliance.

To initiate a repair request, please contact our customer service team at info@luxurycotcompanyco.uk. We may require you to provide supporting evidence, such as photographs a detailed description of the fault or non-compliance.

Repair services will be provided at our discretion. We reserve the right to examine the item and determine the appropriate course of action, which may include repairing or replacing the item.

The timeframe for repairs will depend on the nature and complexity of the issue. We will make reasonable efforts to complete the repair within a reasonable period and keep you informed of the progress.

Repairs will be carried out free of charge if the fault or non-compliance is covered by warranty or if it occurred due to our error. However, if the issue is determined to be caused by misuse, negligence, or improper care, repair costs will be incurred by you.

Please note that slight variations in colour, texture, or other aesthetic elements may occur due to the bespoke nature of our items. These variations should be considered part of the unique character of the product and do not constitute faults or grounds for refunds.

Price and payment
The price of the product(s) and/or services (which includes VAT) will be the price set out in our price list in force at the date of your order unless we have agreed another price in writing. We take all reasonable care to ensure that the price of product(s) advised to you is correct.
If the rate of VAT changes between your order date and the date we supply the product(s), we will adjust the rate of VAT that you pay, unless you have already paid for the product(s) and/or services (including delivery costs) in full before the change in the rate of VAT takes effect.
It is always possible that, despite our best efforts, some of the product(s) and/or services we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product/services’ correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product/services’ correct price at your order date is higher than the price stated in our price list, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may terminate the contract, refund you any sums you have paid for the product(s), and require you to return the product(s) at our expense.
We accept payment with credit and debit cards, electronic funds transfer (EFT), and cash for in-store purchases only. You must pay for any product(s) including delivery costs before we dispatch them.
You must make an advance payment of 50% of the price of the product(s) and services before we commence production of any made-to-order, bespoke, or custom items. This deposit is non-refundable. We will invoice you for the balance of the price of the product(s) and/or services before delivery. You must pay each invoice within 2 weeks or 14 calendar days before the agreed delivery date. We accept payment with credit and debit cards, electronic funds transfer (EFT).
If we are unable to collect any payment from you by the due date, we may charge a storage fee to you the day after the agreed delivery date. This shall accrue on a daily basis until the date of actual delivery.
Our responsibility for loss or damage suffered by you
If we are installing the product(s) and/or providing other services in your property, we will make good any damage to your property caused by us while doing so. However, we are not responsible for the cost of repairing any pre-existing faults or damage to your property that we discover while providing the services.
We only supply the product(s) for domestic and private use. If you use the product(s) for any commercial, business, or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
How we may use your personal information
We will only use your personal information as set out in our privacy policy.
We will only give your personal information to third parties where the law either requires or allows us to do so.
Manufacturing Period
These time frames may vary. Not inclusive of shipping / postage times.
16 weeks - Furniture
12 weeks - Bedding & Soft Furnishings e.g. Rugs, Knitted Moses Baskets, Silk Moses Baskets etc.
Warranty
Returns or errors outside the UK are not covered. We do not cover damages beyond our warranty. The Luxury Cot Company does not assume responsibility for warranty shipping or costs outside the UK.
Social media
The Luxury Cot Company social media platforms are for marketing and sales purposes.
They are not our main source of communication. All communication regarding enquiries and orders must be via WhatsApp or email.
All photos will be posted to our social media platforms and website after sending out unless requested otherwise.
Once uploaded, photographs/videos cannot be removed, as they are part of our social media plan and have undergone editing and scheduling.

We would like to remind you that the safety and well-being of your baby is of utmost importance. While we strive to provide high-quality baby bedding products, it is essential to follow certain guidelines and precautions to ensure a safe sleep environment for your Baby.

For hand-carved items on furniture: We cannot guarantee against breakage of delicate additions such as, flowers, animals, decorative items etc. Feel free to choose or add these items at your own risk, understanding that they may break due to their delicate nature.

The Luxury Cot Company bespoke baby furniture is crafted in accordance with the British standards outlined in BS EN 716-1:2017.

Liability: - We shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of our baby furniture. - The responsibility for ensuring the safety of the baby or child lies with the parents or guardians using the furniture.

The Luxury Cot Company bespoke designs are made to ensure they conform to all relevant regulations. However, if you request a design or modifications that means the cot or crib will not meet the required standards, in such cases, the modified furniture will be intended for decorative purposes only as it fails to comply with the regulatory standards and only to be used accordingly. The Luxury Cot Company shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or misuse of our baby furniture. - The responsibility for ensuring the safety of the baby or child lies with the parents or guardians using the furniture.

E-Gift cards
Whilst our Gift cards do expire after two years, we welcome you to use them at anytime before expiry to purchase products from our company we do not refund under any circumstances.
Other important terms
We may transfer our rights and obligations under these terms to another organisation.
You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
This contract is between you and us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us from taking steps against you at a later date.
These terms are governed by English law.
